Two black men have filed a federal discrimination lawsuit against US Airways.
Miles and MacCraig Warren alleged that they were refused their first class seats because they had jeans and hoodie sweatshirts on. The brothers were asked to change their clothing or they would have to sit in coach. The brothers agreed to change into slacks and button-down shirts and took their first class Denver-to-Phoenix flight.
In the lawsuit, the brothers stated that they ended up sitting with white and Hispanic first class passengers wearing jeans and hoodies as well. Rodney Diggs, the attorney for the two men, gave the following statement:
“They were told that this was the policy if you wanted to ride in first class. They were very upset as and when they saw the other two gentlemen sitting right across from them. This is definitely racial discrimination and a violation of their civil rights.
The brothers are seeking punitive damages, both for discrimination and emotional distress.
